1. Agreement to Terms

By accessing or using Is It AI?'s AI image detection service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Is It AI? provides an AI-powered image detection service that analyzes images to determine whether they were created by artificial intelligence or by humans. The Service includes:

  • Web-based image analysis platform
  • API access for programmatic detection
  • Detection history and reporting
  • NSFW content detection

3. Account Registration

To use the Service, you must:

  • Create an account with a valid email address
  • Verify your email address
  • Be at least 16 years of age
  • Provide accurate and complete information
  • Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Subscription Plans and Payment

4.1 Plans

We offer various subscription plans with different features and usage limits. Plan details, pricing, and quotas are displayed on our pricing page.

4.2 Billing

  • Subscriptions are billed in advance on a monthly basis
  • All fees are non-refundable unless otherwise stated
  • You authorize us to charge your payment method for recurring fees
  • Prices may change with 30 days notice

4.3 Quotas

Each plan includes a monthly detection quota. Unused quota does not roll over to the next billing period. You can upgrade your plan at any time to increase your quota.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to bypass, disable, or circumvent any security features
  • Reverse engineer, decompile, or disassemble the Service
  • Share your account credentials or API tokens with unauthorized parties
  • Resell or redistribute access to the Service without authorization
  • Submit content that infringes intellectual property rights
  • Use automated methods to abuse or overload the Service
  • Interfere with other users' access to the Service

6. API Usage

If your subscription includes API access:

  • API tokens are confidential and must be kept secure
  • You are responsible for all API calls made with your token
  • Rate limits apply as specified in your plan
  • We may revoke API access for violations of these Terms
  • API availability is subject to maintenance and updates

7. Content and Images

7.1 Your Content

You retain ownership of images you submit for analysis. By submitting images, you grant us a limited license to process them for detection purposes and to anonymously use them for improving our models.

7.2 Prohibited Content

You may not submit:

  • Content depicting child sexual abuse material (CSAM)
  • Content you do not have the right to submit
  • Content intended to harass or harm others
  • Malicious files or code

7.3 Content Removal

We reserve the right to remove any content that violates these Terms without notice.

8. Accuracy and Limitations

While we strive for accuracy, you acknowledge that:

  • Detection results are probabilistic assessments, not guarantees
  • No AI detection system is 100% accurate
  • Results should be used as one factor in decision-making, not the sole determinant
  • Detection accuracy may vary based on image quality, AI model used, and post-processing

The Service is provided for informational purposes. You should not rely solely on our results for legal, employment, academic, or other consequential decisions.

9. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Is It AI? and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

All trademarks, logos, and service marks displayed are our property or the property of their respective owners.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS
  • UNINTERRUPTED OR ERROR-FREE OPERATION

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISITAI SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages arising from reliance on detection results
  • Damages exceeding the amount you paid for the Service in the 12 months preceding the claim

13. Indemnification

You agree to indemnify and hold harmless Is It AI?, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Service

14. Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended inactivity

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which Is It AI? operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Is It AI? regarding the Service and supersede any prior agreements.
